DECREE ON THE ORGANIZATION AND ACTIVITIES OF THE LAO NATINAL CHAMBER OF COMMERCE
- Pursuant to the law on the Government of Lao PDR No 02 / NA, dated 06 / 05 /2003. - Pursuant to the Resolution of the Minister Council on the establishment of the Chamber of Commerce No 0598 / CPC, dated 05 / 05 /89. - Pursuant to the proposal of Minster of Commerce No 0715 / MC.CC, dated 18 / 07 /2003.

Chapter I Position and Role
Article 1 – Position
The Lao National Chamber of Commerce and Industry, Call in short is “LNCCI” is the social organization of the business people, it is the connection between the state organizations and the enterprise units and it is the representative for the employers and other associations or business groups, other enterprise units that belong to the state, cooperation, joint venture and other private enterprises within entire agencies that established under the Laws of Lao PDR.
Article 2- The role.
The LNCCI is the organization to coordinate in economy in which it has the role to persuade, organize, gather and educate in order to guide the enterprise units in running business to comply with laws and regulations and also to protect the legitimate benefits of its members.
Chapter II Functions and Authority
Article 3- Functions The LNCCI has the following functions - Collecting, gathering various opinions, proposal and suggestion from business sectors. - Coordinating between enterprise and the state agencies in order to consult on business issues. - Proposing opinion, recommendation to the state agencies concerning facilitation in running business, promoting production to export and consume in the country , creating conditions to facilitate the production of the Lao PDR to be able to compete within the international Market. - Giving opinion and recommendation to the bills and policies on economy. - Performing some work that assigned by the government in order to extend the cooperation and relations on economy and commerce with foreign countries that have or do not have the diplomatic relations with the Lao PDR. Article 4 – Authority The LNCCI has the following authority: - Negotiating on commerce, industry, services and other with the concerned agencies of the state and foreign countries in accordance with the assignation of the Government. - Issuing and managing the certificate of the resources of goods. - Approving the establishment of associations of groups and the board executive director of the local Chamber of Commerce and Industry. - Approving its representatives in abroad. - Approving personnel within its body and personnel of associations or business persons groups to work or study in other foreign country. - Receiving financial support for the government, individuals and other organizations in the country and abroad.
Chapter III Structure of the Organization
Article 5- Structure of the organization The LNCCI comprises with the executive Directors, permanent Secretary, control Board and Office of Secretariat The executive Director Board and the control board appointed by the conference of the members and committees of this board and have a period of three years and can be reelected if expired. The permanent Committees comprises of the president or vice president of the executive management Committees which be elected by the executive management Board. The Secretariat is appointed by the president of executive Management Board on the basics of the proposal of its member. The executive Management Board comprises of the president and some Vice Presidents which are elected by the Executive Management Committees of the CCI
Article 6-Administration The LNCCI administers the local CCI, the representatives of LNCCI in abroad, the foreign CCI and that obtain permission to run their business in the LAO PDR.
The foreign CCI and foreign CCI with Lao are able to establish and run their business in Lao PDR if they get permission from the Ministry of Foreign Affaires. This ministry will formulate the regulations concerning the establishment and the activities of the aforesaid organizations.
Wherever the LNCCI is situated there is no need to establish the local CCI.
Article7- the basics principles of the performances. All organizations and performances of the LNCCI have to observe their own regulations and this Decree and other relevant laws and regulations.
The local CCI organizes and performs their work within the scope of their locality under the basics principles of the organization and performances the same as the LNCCI which is prescribed in this decree except some authority and functions that have specific manner of LNCCI.
Chapter IV Financial System
Article8- Budget.
The LNCCI is the organization that has the individual entities, it has its own specific budget and its performs independently on their own budget.
Article 9- Sources of revenues
The main revenues of the LNCCI has as follows :
- the member’s fee, - the service’s fee of issuing and managing the certificates of the sources of goods, - other services fee, training, seminar, consultation services, data supply and goods exhibition, - services of fee management of the state business on the agreement of the Government and Local Authorities. - the support of the state.
Chapter V Final Provision
Article10- the implementation.
The LNCCI is the organization that have to implement this Decree other sectors and the concerned local authorities have to cooperate and facilitate for the LNCCI to perform its activities.
Article11- the seal.
The LNCCI and Local CCI have their own seal in order to use in their performances.
Article12-
This Decree has come to force after the signature and replace the Decree number 175/PM,dated 20/08/98 concerning the scope of responsibilities of LNCCI.
